Gmaven Website Terms of Use

These are the site-wide terms for the Gmaven website (gmaven.com) and blog (blog.gmaven.com). They do not govern the CRE software or Data services (each provided under its own agreement) or any Gmaven app (each governed by its own terms). Please read them with our Website Privacy Policy and Cookie Policy.

This section provides the supplier information required for an electronic transaction in South Africa.

2. Agreement to these terms

By using the Gmaven website or blog, you agree to these Terms of Use. If you do not agree, please do not use them. We may update these terms; the current version and its date appear at the top, and continued use after a change means you accept the updated terms.

3. What this website is

The website tells you about Gmaven and our products, lets you contact us, and links to our blog and to our customer sign-in. Our products are provided separately:

  • the Gmaven CRE software and the Gmaven Data services are provided to customers under their own agreements, which govern those products (not these terms); and
  • where you sign in to the CRE software, your use of it is governed by that product's agreement.

The website is for information and business purposes. Its content is not advice, and is not an offer capable of acceptance.

4. Acceptable use

You agree to use the website lawfully, and you must not, without our prior written permission:

  • scrape, copy, harvest, or systematically extract any content, listings, or data from the website;
  • use any robot, spider, or other automated means to access, monitor, or copy the website beyond ordinary browsing;
  • introduce any virus or harmful code, or otherwise interfere with the proper working of the website;
  • impose an unreasonable or disproportionate load on the website or its infrastructure;
  • attempt to gain unauthorised access to, or probe or test the security of, the website or related systems; or
  • infringe anyone's intellectual property or other rights, or post unlawful, defamatory, or harmful material.

5. Accounts and sign-in

If you hold a Gmaven account (for example for the CRE software), you are responsible for keeping your login details secure and for activity under your account. The product's own agreement governs that account.

6. Intellectual property

The website, its content, and the underlying Gmaven data, data structure, compilation, and methodology are owned by Gmaven or its licensors and are protected by law, including copyright and database and compilation rights. You may view and use the website for its intended purpose only; no other rights are granted, and all rights not expressly granted are reserved. Third-party names, logos, and trade marks shown on the website (for example customer logos) belong to their respective owners and are used with permission or to identify those parties.

7. Accuracy and availability

We make reasonable efforts to keep the website accurate and available, but we do not warrant that it is current, complete, error-free, secure, or uninterrupted, and we may change, suspend, or withdraw all or part of it at any time.

8. Third-party links

The website links to third-party websites and services (including our blog platform, our sign-in, and customer websites). We do not control those, and we are not responsible for their content, their availability, or their handling of your information. Their own terms and policies apply.

9. Disclaimer and limitation of liability

The website is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Gmaven is not liable for any loss or damage of any nature, whether direct, indirect, incidental, special, punitive, or consequential, including any loss of profit, revenue, data, or opportunity, arising out of or in connection with your use of, or inability to use, the website, or your reliance on its content, whether based on contract, delict, or any other basis. Nothing in these terms excludes or limits any liability that cannot lawfully be excluded or limited.

10. Indemnity

You agree to indemnify and hold Gmaven harmless against any claim, loss, or expense arising from your breach of these terms or your unlawful or improper use of the website, to the extent permitted by law.

11. Privacy and cookies

We process personal information and use cookies as described in our Website Privacy Policy and our Cookie Policy, which form part of your use of the website.

12. Governing law and disputes

These terms are governed by the laws of the Republic of South Africa.

Any dispute arising from these terms or from your use of the website will be referred to and finally resolved by arbitration, conducted in English in Pietermaritzburg under the rules of the Arbitration Foundation of Southern Africa (AFSA). The unsuccessful party will bear the costs of the arbitration.

13. General

If any provision of these terms is found to be unenforceable, the rest remain in force. Our failure to enforce any right is not a waiver of it. These terms, together with the Website Privacy Policy and Cookie Policy, are the whole agreement between you and us about your use of the website.
